NASA's Jupiter-bound Juno changes its orbit

ScienceDaily (Aug. 30, 2012) ? Earlier today, navigators and mission controllers for NASA's Juno mission to Jupiter watched their computer screens as their spacecraft successfully performed its first deep-space maneuver. This first firing of Juno's main engine is one of two planned to refine the spacecraft's trajectory, setting the stage for a gravity assist from a flyby of Earth on Oct 9, 2013. Juno will arrive at Jupiter on July 4, 2016.

The deep-space maneuver began at 6:57 p.m. EDT (3:57 p.m. PDT) today, when the Leros-1b main engine was fired for 29 minutes 39 seconds. Based on telemetry, the Juno project team believes the burn was accurate, changing the spacecraft's velocity by about 770 mph (344 meters a second) while consuming about 829 pounds (376 kilograms) of fuel.

"This first and successful main engine burn is the payoff for a lot of hard work and planning by the operations team," said Juno Project Manager Rick Nybakken of NASA's Jet Propulsion Laboratory in Pasadena, Calif. "We started detailed preparations for this maneuver earlier this year, and over the last five months we've been characterizing and configuring the spacecraft, primarily in the propulsion and thermal systems. Over the last two weeks, we have carried out planned events almost every day, including heating tanks, configuring subsystems, uplinking new sequences, turning off the instruments and increasing the spacecraft's spin rate. There is a lot that goes into a main engine burn."

The burn occurred when Juno was more than 300 million miles (483 million kilometers) away from Earth.

A second deep space maneuver, of comparable duration and velocity change, is planned for Sept. 4. Together, they will place Juno on course for its Earth flyby, which will occur as the spacecraft is completing one elliptical orbit around the sun. The Earth flyby will boost Juno's velocity by 16,330 mph (about 7.3 kilometers per second), placing the spacecraft on its final flight path for Jupiter. The closest approach to Earth, on Oct. 9, 2013, will occur when Juno is at an altitude of about 310 miles (500 kilometers).

"We still have the Earth flyby and another 1.4 billion miles and four years to go to get to Jupiter," said Scott Bolton, Juno's principal investigator from the Southwest Research Institute in San Antonio. "The team will be busy during that whole time, collecting science on the way out to Jupiter and getting ready for our prime mission at Jupiter, which is focused on learning the history of how our solar system was formed. We need to go to Jupiter to learn our history because Jupiter is the largest of the planets, and it formed by grabbing most of the material left over from the sun's formation. Earth and the other planets are really made from the leftovers of the leftovers, so if we want to learn about the history of the elements that made Earth and life, we need to first understand what happened when Jupiter formed."

Juno was launched on Aug. 5, 2011. Once in orbit, the spacecraft will circle Jupiter 33 times, from pole-to-pole, and use its collection of eight science instruments to probe beneath the gas giant's obscuring cloud cover. Juno's science team will learn about Jupiter's origins, structure, atmosphere and magnetosphere, and look for a potential solid planetary core.

Juno's name comes from Greek and Roman mythology. The god Jupiter drew a veil of clouds around himself to hide his mischief, and his wife, the goddess Juno, was able to peer through the clouds and reveal Jupiter's true nature.

NASA's Jet Propulsion Laboratory, Pasadena, Calif., manages the Juno mission for the principal investigator, Scott Bolton, of Southwest Research Institute in San Antonio. The Juno mission is part of the New Frontiers Program managed at NASA's Marshall Space Flight Center in Huntsville, Ala. Lockheed Martin Space Systems, Denver, built the spacecraft. JPL is a division of the California Institute of Technology in Pasadena.

Independent Schools Offer Several Benefits For Students

Independent schools differ from public institutions in a few ways. The main one is that they are self-funded and self-governed, so they do not depend on the city, state, or federal government to stay funded. Instead, they usually charge tuition, and they may also accept cash donations. No matter where the funding comes from, there are a few advantages of a school that does not rely on the government for money.

One of the most important benefits of independent schools is that they usually offer high-quality education for all students. This is because they can carefully budget based on the money they either already have or know they will get from benefactors. By contrast, a public school often has a fluctuating budget that depends on the tax rate and overall economy since it is funded by taxpayers. Therefore, in a bad economy, programs may be unexpectedly cut, and due to this, there may not be a good variety of classes available for students.

This advantage applies to extracurricular programs, too. Since many independent schools have control of their own budget, they can offer a wide variety of after-school options. If you want your kids to have their pick of several sports, clubs, and performing arts options, choosing this type of school may be a good idea. This will help them with their college applications since most universities like to see a variety of extracurricular activities on any student?s resume. If your kids have a passion for a program that the typical public school cannot afford, independent schools may be the best choice.

Additionally, due to the fact that the budget is often higher, this type of option usually attracts experienced teachers. This can clearly be quite beneficial for students. You want to send your kids to an educational institution that is able to appeal to the best teachers, not just new graduates or average teachers who are simply desperate for a job. This type of educational institution offers enough benefits and opportunities to teachers that it has its pick of several applicants. Such teachers usually end up offering students the help they need, which may include one-on-one assistance and constant communication with parents to update them on how their kids are doing.

If you are trying to decide whether public or independent schools are the best for your kids, you should keep these benefits in mind. There is no way to say that either type is the best for everyone, but you can look at the benefits of each. Then you should schedule a time to check out the campus and talk to administrators before making up your mind.

Highlights from the Fed's US economic survey

WASHINGTON (AP) ? A Federal Reserve survey released Wednesday found that the economy grew moderately in July and early August, and hiring was more robust than in the previous six-week period.

The Fed report, known as the Beige Book, said that nine of its 12 banking districts reported growth that was "modest" or "moderate." That was roughly in line with the findings of the previous survey.

The report is based on anecdotal information from the regional districts and covers the period from July through Aug. 20.

Here are some highlights:

BOSTON (includes Maine, Vermont, Massachusetts, New Hampshire, Rhode Island and part of Connecticut):

Reports from businesses were mixed. Tourism contacts and some retailers cited strong results. But other merchants were more downbeat. Manufacturers reported solid performance but some said sales had fallen compared to a year ago.

NEW YORK (includes New York and parts of Connecticut and New Jersey):

The area experienced modest growth. Retailers reported generally favorable results and tourism activity remained strong. Manhattan's commercial real estate market picked up somewhat.

PHILADELPHIA (includes Delaware and parts of Pennsylvania and New Jersey):

Business activity grew slowly but the pace shifted in a few sectors. Manufacturing declined more slowly, while retails sales grew faster.

CLEVELAND (includes Ohio, Kentucky and parts of Pennsylvania and West Virginia):

The area reported modest growth. Manufacturing output decreased. Construction activity picked up. Retailers saw a modest rise in sales during July and motor vehicle purchases held steady.

RICHMOND (includes Virginia, Maryland, North Carolina, South Carolina, District of Columbia and part of West Virginia):

Economic activity was mixed. Manufacturing and hiring weakened. But retail sales improved, summer tourism was strong and residential real estate activity inched up.

ATLANTA (includes Georgia, Alabama, Florida and parts of Louisiana, Mississippi and Tennessee):

The area experienced modest growth. But many businesses expressed concerns about their short-term outlook. Retailers saw slower activity outside of autos sales.

CHICAGO (includes Iowa, Wisconsin, Michigan and parts of Illinois and Indiana):

Growth continued at a moderate but slower pace. Businesses expressed concerns about the outlook in the second half of the year. The specifically cited a pending budget impasse in Washington, which could result in tax increases and less government spending. They also are worried about weaker growth in Europe and Asia, which could hurt U.S. exports and factory production.

ST. LOUIS (Includes Missouri, Arkansas and Kentucky, and parts of Illinois, Indiana, Tennessee and Mississippi):

The local economy grew modestly. Retail sales and auto sales increased, and the housing market showed improvement. But manufacturing was mixed.

MINNEAPOLIS (includes Montana, North Dakota, South Dakota, Minnesota and parts of Wisconsin and Michigan):

Businesses reported modest growth, noting stronger consumer spending, tourism, professional services, construction and real estate. Activity slowed slightly in manufacturing and the energy sector.

KANSAS CITY (includes Wyoming, Nebraska, Colorado, Kansas, Oklahoma and parts of Missouri and New Mexico):

The economy grew moderately. Retailers and auto dealers reported higher sales and expected increased activity in the months ahead. Agricultural conditions deteriorated under extreme drought conditions.

DALLAS (includes Texas and parts of New Mexico and Louisiana):

The economy grew moderately. Manufacturing expanded, and retail sales edged up. Financial firms noted softening loan demand. Wage and price pressures were modest.

SAN FRANCISCO (includes California, Washington, Oregon, Idaho, Nevada, Utah, Arizona, Hawaii and Alaska):

Economic activity grew modestly. Inflation was tame, although employers saw little pressure to raise pay.

9 month estate planning deadlines might seem tight after losing ...

Most people choose not to think of worst case scenarios. Losing a spouse unexpectedly is a devastating event, and most people will never have to experience this. However, the unexpected can happen, and it is important to be prepared. While planning for a "what if" situation is the best idea, sometimes a spouse might die and a couple might not have an estate plan in place. This might leave the surviving spouse wondering what happens next.

Within 9 months of the death of a spouse, people are required to file estate planning paperwork in New Jersey. Often, when there is a loss of a very close loved one, the grieving period is much longer than 9 months long. While everyone handles traumatic situations differently, it is important to get financial matters taken care of quickly after a person's death.

Sometimes family members and friends will encourage a person to take time to grieve and not think about the financial impact of a death. While it is important to understand the emotions of a family member's death, it is also important to get financial matters under control soon after a death. Speaking with financial professionals and an experienced estate planning attorney might be a wise decision.

They can help make sure a person is set up for a positive financial future. They can also put in place an estate plan for a living spouse and their children. By planning for the unexpected, people can help prevent further stress if an unexpected event occurs.

FAA Reviewing In-Flight Electronics Use - Business Insider

The Federal Aviation Administration is revisiting the rules surrounding the use of in-flight electronics, reports Macworld.

We're all familiar with the period during takeoff and landing when laptops and phones have to be turned off in order to make sure there's no radio interference.

Now the FAA is forming an investigative group consisting of "representatives from airlines, mobile companies and aviation manufacturers, as well as pilot, flight attendant and passenger groups."

It will meet for six months beginning this Fall and depending on its findings, we might see some more relaxed rules regarding the use of in-flight electronics.

Legal Aspects of Your Business: Copyright, Trademarks, & Contracts ...

My least favorite part of running my business is doing the books. I understand the importance of doing them each month, but they always seem to get pushed down to the bottom of the to-do list. My most favorite part of running my business is educating creative entrepreneurs about their legal rights. For some of you, this is the part of running your business?that you keep pushing off. Just like I can?t put off my books forever, it?s a pretty sure bet that you will encounter legal issues at some point. And hopefully being on top of the basics will make that interaction much less painful.

To help you be a little more proactive about getting your business in legal shipshape, I?m going to be writing a series of posts dedicated to discussing some of the most common legal interactions creative businesses face. I will arm you with the tools and checklists to make this process less daunting. To start, I?m going to outline each of the main issues that you need to tackle: opening and running a business, copyright, trademark, and contracts. I?ll dive into each topic thoroughly in upcoming blog posts:

1. Opening and Running a Business

In this post, I will focus on a basic list of legal items that businesses need to open and run. Not all of the items on this list may be relevant to your business. For example, if you operate as a sole proprietor, you won?t need to prepare a partnership agreement, operating agreement, or articles of incorporation. Requirements also vary depending on the type of product you are making, so we will discuss what you might need to investigate to determine?if a specialized license is required for your business. For example, those of you creating garments in California might need to obtain a Garment Manufacturing Certificate.

2. Copyright

In most creative businesses, copyrights are the most valuable asset.?More importantly, understanding copyright law and your rights are critical to protecting this asset. In my Copyright post, I will help you develop a system to not only determine if you should be registering your work with the U.S. Copyright Office, but how to monitor the use of your work across the Internet. Finally, this post will give you resources to tackle the most cost-effective tool in the Internet copyright enforcement toolbox, the DMCA takedown notice.

3. Trademark

Most creative enterprises fail to understand the value that their brand holds. They think that trademark laws only apply to big companies like Coca-Cola or Apple. However, just like copyright, monitoring the use of your brand is very important. In my Trademark post, we?ll discuss how to select a name so that it has the strongest trademark protection, how to monitor the use of your brand, and finally, when it might be the time to make the leap to registering your trademark with the U.S. Patent and Trademark Office.

4. Contracts

My post on Contracts will cover one of the easiest ways to protect your creative empire: having a contract in place. I know that many of you squirm when you sign a contract. But contracts really just outline the terms of your relationship and define a process for what happens when things go wrong. For example, your contract should define what you are and are not providing or what happens when someone shoplifts a piece of jewelry from one of your consignment retailers.

Share with us below some of the legal items that you keep pushing to the bottom of your to-do list, so that I can hopefully give you the tools to make those tasks seem more manageable!

**I?m a lawyer so my insurance carrier likes me to use disclaimers. The information in this post is?made?available for educational purposes only, not to provide specific legal advice. I am not your attorney and this post is not a substitute for competent legal advice from a licensed attorney in your state.**

Uncovering Destiny through Astrology | Astrology

Entertainment | Astrology | * Written by David Daniel | Monday, 27 August 2012 02:07 | Word Count: 546

There are many stern believers of astrology but there are some who question the authenticity of Astrology. How many of us are truly sure about the accuracy of these predictions. Read on to find out more about this mystic occult science. Since ancient times astrologers have looked up to the skies and observed the positions of stars visible to the naked eye. Based on the positions of stars predictions and fortune forecasts were made. These were mostly fortune tellers who wandered and went about revealing the future. Some believe that the Vedic form is the oldest while many others believe that Chinese astrology is the oldest known form of astrology. Whether Vedic or Chinese, or for that matter western astrology, all astrologers have one thing in common and that is the art of predicting the future. The zodiac has been divided into 12 main signs and these signs stretch across the twelve months of a year.

Planets play a significant role in determining astrological predictions. Modern scientific inventions have helped astrologers make predictions well in advance. Yearly horoscopes are available for one to know what's in store for the coming year. Daily predictions and weekly predictions have become the order o f the day. One can read about their fortune on a daily basis. There are various mediums now available to users to know about their future. These mediums include TV shows, newspapers, and astro websites.

Birth details are significant for predicting accurately. Astrologers find it difficult to make predictions without the believer's accurate birth details. Birth details determine the sun sign of the believer. It also helps one ascertain what can possibly happen in the near future.

Unlike vedic astrology Chinese Astrology believes in associating the 12 sun signs with animals. Hence, these are also popularly called Chinese Animal Signs.? Personality traits are also associated with each sign. This helps the astrologer analyse the personality type of the believer.

One starts their love life or married life based on how well matched the charts are. A higher compatibility is an indication of better future prospects for the couple. In India, it is the Kundali that becomes the focal point before moving ahead with one's marriage plans. The marriage date is fixed after determining the muhurat. The kundalis are matched and the marriage is fixed.

Astrology is also very useful for those who plan to have a successful career. Career charts and lucky areas for work are determined based on the person's astro sign. This helps the believer in avoiding hurdles. Finances can also remain safe by taking precautionary measures. The user can make decisions based on how favourable the planets are.

Last but not the least; it's the Astrologer who plays a significant role in making astrological predictions. Astrologers are experts who have studied this mystic science in depth and are capable of making predictions. Astrologers further specialize in various branches of astrology to make highly accurate predictions and help believers. These astro branches may include ? Vedic astrology, Vaastu, Feng Shui, Crystal Healing, Palmistry, Rune Reading and Tarot Reading, etc.

(AP) ? When man first harnessed fire, no one recorded it. When the Wright Brothers showed man could fly, only a handful of people witnessed it. But when Neil Armstrong took that first small step on the moon in July 1969, an entire globe watched in grainy black-and-white from a quarter million miles away

We saw it. We were part of it. He took that "giant leap for mankind" for us.

Although more than half of the world's population wasn't alive then, it was an event that changed and expanded the globe.

"It's a human achievement that will be remembered forever," said John Logsdon, professor emeritus of space policy at George Washington University. Those first steps were beamed to nearly every country around the world, thanks to a recently launched satellite. It was truly the first global mass media event, Logsdon said. An estimated 600 million people ? 1 out of every 5 on the planet ? watched.

When people look back hundreds of years from now, the two historical events likely to be long remembered from the 20th Century are the moon landing and the first atomic bomb, said Smithsonian Institution space curator Roger Launius.

"There is no way to overestimate that significance in human history and he is forever linked to that," Launius said of Armstrong, who died Saturday at age 82.

The late science fiction author Arthur C. Clarke wrote that the Apollo 11 moon landing was "one of the great divides in human history; we are sundered from it forever by the moment when Neil Armstrong and Buzz Aldrin stepped out on to the Sea of Tranquility. Now history and fiction have become inexorably intertwined."

Since that day, there's been a common phrase: "If we can send a man to the moon, why can't we ... ?" with the blank filled with a task that seems far less difficult.

Armstrong's small step was that leap in confidence telling the world "if we can do this, we can do anything," said Howard McCurdy, a professor of space and public policy at American University and author of the book "Space and the American Imagination."

"He took something that 20 years earlier was pure fantasy and turned it into reality and if we could do that for space we could do it for anything," McCurdy said Saturday.

The Apollo 11 moon landing was the finish line in a decade-long space race started by the Soviet Union. And so the first steps on the moon coming from an American civilian had many meanings. Getting there first showed American technological superiority, but Armstrong mentioned mankind ? not Americans ? demonstrating that this was a moment for the people of Earth, McCurdy said.

Armstrong and Aldrin left a plaque on the moon that read:? "Here men from the planet Earth first set foot upon the moon. July 1969 A.D. We came in peace for all mankind."

For all mankind. And that's how the world took it.

"The success for America (is a) success for every living man" reported the Swahili-language newspaper Nguromo of Dar.

And if that wasn't enough, Armstrong and Aldrin also left a patch to commemorate NASA astronauts and Soviet cosmonauts who had died in pursuit of space.

"It was special and memorable but it was only instantaneous because there was work to do," Armstrong told an Australian television interviewer this year.

The Cold War may have slightly muted the significance of the event at the time, but over the years the importance of the moon landing has only grown, Logsdon said.

It's permeated into culture. The moon landing is in movies, television, books, songs and it was even Michael Jackson's signature dance step. That's probably because in some ways that moon walk touched something that has been hard-wired into humanity: the need to explore. For 25,000 years, humans have been migrating and pushing into new places. Armstrong took it to new heights.

John Glenn, the first American to orbit the Earth noted it was "the first time any human being set foot on a place other than Earth, and that's a pretty big step."

(AP) ? Republican officials abruptly announced plans Saturday night to scrap the first day of their national convention, bowing to the threat of Tropical Storm Isaac as it bore down menacingly on Florida.

"The safety of those in Isaac's path is of the utmost importance," tweeted Mitt Romney, his formal nomination as presidential candidate pushed back by a minimum of 24 hours from Monday night to Tuesday.

The announcement was made as delegates and other convention-goers flocked to the Tampa Bay area by the planeload for what had been scripted as four days of political pageantry and speechmaking with a purpose ? to propel Romney into the fall campaign against President Barack Obama.

Officials said they hoped to begin laying out a revised schedule on Sunday.

Romney campaigned in battleground Ohio during the day, pledging to help female entrepreneurs and innovators who are eager to create small businesses and the jobs that go with them. It was an economy-themed countdown to a convention taking shape in a city already bristling with security ? and bracing for a possible hurricane.

"Women in this country are more likely to start businesses than men. Women need our help," said the Republican presidential challenger, eager to relegate recent controversy over abortion to the sidelines and make the nation's slow economic recovery the dominant issue of his convention week.

Reince Priebus, the Republican Party chairman, told reporters on an early evening conference call that no state delegations had changed their travel plans because of the storm. "Everyone is planning on being here and we hope we are up and running and expect all of our delegates to be here," he said.

Yet with rain and high winds in the forecast, and with the threat of a storm surge and possible flooding, convention organizers said they were making contingency plans to move delegates who have been booked into beachfront hotels to other locations if necessary.

North Dakota Republican Party Chairman Stan Stein said he needed instructions on preparing emergency kits for the 65 to 70 people in his state's contingent staying at a hotel 200 yards off the water in Treasure Island. "We do blizzards. We can handle them, but we're just going to go on the advice we're getting from hotel management on how to prepare for this," he said.

"Our first priority is ensuring the safety of delegates, alternates, guests, members of the media attending the Republican National Convention, and citizens of the Tampa Bay area," convention CEO Bill Harris said in an emailed announcement that followed private conversations involving Romney's campaign, Florida Gov. Rick Scott's office, security officials and others.

The announcement said that while the convention would officially be gaveled into session on Monday as scheduled, the day's events would be cancelled until Tuesday.

The announcement made the GOP convention the party's second in a row to be disrupted by weather. Four years ago, the delegates gathered in St. Paul, Minn., but Hurricane Gustav, slamming the Gulf Coast, led to a one-day postponement.

In that case, party officials rewrote their script to make President George W. Bush's speech into a video appearance, and to cancel plans for Vice President Dick Cheney to appear before the delegates. Both men were unpopular at the time.

Four years later, there was no immediate sign that Romney's forces would do anything other than squeeze two nights' of platform programming into one. Nor did it appear the postponement would cost them much in political terms, since the television networks had already announced they would not be carrying any of Monday's events live.

Despite the disruption, Priebus said, "we are optimistic that we will begin an exciting, robust convention that will nominate the Romney-Ryan ticket."

Plans had called for the convention to open Monday with quick ratification of a conservative platform expected, followed by Romney's nomination in a traditional roll call of the states timed for network evening news coverage.

Barring further postponements it will end Thursday with his prime-time acceptance speech, which aides hope will propel him into a successful fall campaign and, eventually, the White House.

The polls made the race a close one, narrow advantage to Obama, as two weeks of back-to-back conventions approached. Hundreds of millions of dollars have been spent on television ads, with hundreds of million more to come, almost all of it airing in a small group of battleground states expected to settle the election.

The list included Florida as well as North Carolina, where the Democratic National Convention will be held in one week's time.

Scott declared a state of emergency earlier in the day as the storm approached the Florida Keys, more than 400 miles from Tampa. Forecasters said it was on a track to head west of the convention city, but predicted strong winds and rain at a minimum on Monday as the delegates were to board buses for their first trip to the hall.

"We are a hospitality state. We know how to take care of people and we want to ensure their safety," Scott said.

Apart from weather concerns, a heavy security presence was already in evidence. Miles of fencing were designed to create a secure zone around a tract of land that included the convention hall, the hotel where Romney will stay and a nearby convention center where journalists and others worked.

Obama did his best to intrude on the Republican unity tableau.

In an interview with The Associated Press, he accused Romney of holding "extreme positions" on economic and social issues, while pledging a willingness on his own part to agree to "a whole range of compromise" with Republicans if he is re-elected.

He did not elaborate, but his pledge seemed designed to appeal to independents and other voters who say they are tired of seemingly perpetual campaign bickering and Washington gridlock.

Plans for Vice President Joe Biden to campaign in Florida were cancelled, also because of the threat posed by the storm.

But Romney said Obama's entire campaign rested on his ability to persuade people to ignore his record and listen instead to his rhetoric.

"It is not his words people have to listen to. It's his action and his record," he said in his appearance in Powell, Ohio. "And if they look at that, they'll take him out of the office and put people into the office who'll actually get America going again."

Romney's speech included an appeal to women made on economic grounds rather than on the basis of social issues like abortion, the sort of approach the Republican hopes will eat into Obama's polling advantage among female voters.

"I want to make sure that we help entrepreneurs and innovators. I want to speak to the women of America who have dreams, who begin businesses in their homes, who begin businesses out in the marketplace, who are working at various enterprises and companies," he said.

Romney envisioned an economic resurgence fueled by abundant energy, expanded trade and a skilled workforce. If that happens, "America is going to surprise the world. We're going to stand out as a shining city on a hill in part because of our extraordinary economy," he said to the cheers of an estimated 5,000 supporters.

Romney's determination to turn the attention to the economy follows two weeks of controversy over Medicare, courtesy of Obama's campaign, as well as abortion, the result of a comment by Rep. Todd Akin, the party's candidate in a Senate race in Missouri.

Romney joined an unsuccessful effort by party leaders to force Akin to quit his race after he said women who are raped rarely become pregnant, a view unsupported by medical evidence.

He also fought back hard in recent days in person and television advertising against Obama's allegations that he and running mate Ryan would remake Medicare in a way that would undermine the health of future seniors.

A Customer Service Network Can Give You an Edge

I drove for Retriever Towing in Portland, Ore., for 11 years, and my time there is the source of many of my stories. Retriever is the top impound company in Portland, and I occasionally help them with marketing. One thing we did recently was promote another sister company, a full-service automotive shop, to the businesses Retriever serves by offering a discount to the businesses, their employees, their customers and (in the case of residential properties) their residents. This type of cross-promotion helps all parties. The vehicle owner gets a discount, the automotive shop gets more customers, the impound company strengthens its relationship with its account base, and the accounts strengthen their relationship with their customers and residents.

After I left Retriever in 1997, I went to work for a competitor, Sergeants Towing, where I moved into management. I started as a driver and struck up a friendship with the office manager, who had been a small business owner herself and, like me, was new to the company. She had some ideas about how to improve the company and she had a unique perspective, coming from a different industry. We were talking one afternoon as she washed her car, and it started out as one of those ?I wish? conversations. You know, I wish we did things this way, I wish we did things that way. She was ?only? the office manager, and at that point I was ?only? a driver. I was ready for change, so I simply suggested that we start working on a couple of projects together without asking for approval from ownership or upper management. We would enlist help from others as needed, ask for money if we had to, write up procedures and present them to decision-makers as if the task had been assigned to us, and generally just take the bull by the horns, rather than complaining on the sidelines.

One thing that managers often don?t have enough of is time, and if you can complete something of value that helps them, they often will not care whose idea it was or how it came about.

One of the first things we worked on was an idea I had heard on an NPR program: developing a customer service network. If you look at your customer base, especially your customers that are businesses, they utilize the services of many different kinds of service providers. You might provide one or two or three of those services, and you certainly want to serve them in as many ways as possible. If you own a tow company, and automotive shop, and a body shop, you might want to secure as many fleet accounts as possible by selling all three services to them. You can offer incentives, such as discounts, for those accounts that take advantage of this, and you can be sort of a one-stop shopping center for them, which is certainly convenient and advantageous for them.

We took it a step further and went to other companies who served our accounts ? or could serve them ? and asked them to be part of our customer service network. All we asked them to do is to offer some sort of discount or incentive to our customers in exchange for the privilege of promoting their business to our customers. Now, who would turn that down? It was free advertising for them. We simply included their information on our website, and we put together a list of providers for our account reps to give to our accounts. Because we were an impound company, our accounts were primarily business and property owners. We went first to our own providers and to the accounts themselves to find network partners, and within two weeks we had a group that included our card-lock fuel company, a sign company, a lot sweeping company, a security firm, a web developer, a carpet and linoleum installer, a janitorial company, a painter, a legal firm, our own automotive shop, a body shop, an accounting firm, a waste disposal firm, a landscaper and a pest control company.

When we had exhausted that avenue, we went to a professional association we belonged to and found another group of service providers with the same type of customers we had, and we doubled the size of the group. Can you see how banding together as a network helped all of us to strengthen our relationships with our customers, and to thereby secure that business even more strongly than we already had? We were an impound company ? we couldn?t go to our best account and haul away their garbage (well, their actual garbage, not abandoned vehicles) but we could find a waste disposal company who would give them a discount because they were our customer.

It was win-win-win. We did not stipulate to the other service providers what kind of discount or incentive had to be offered, nor did we promote the terms or nature of the discount or incentive, unless they wanted us to. We kept it as simple as possible, and any service provider could opt out at any time. In fact, the only companies who turned down the opportunity to participate were companies who were so busy that they couldn?t handle any more new business. They recognized that by just saying yes, they were going to start getting more phone calls and inquiries.

Our account reps loved it. It gave us an edge. Instead of walking into a competitor?s account and trying to convince them that we would have better response times, make fewer mistakes, install custom signs, and do a better job of reducing negative backlash from impounded vehicle owners, we had something in black-and-white that had a tangible financial benefit for them. And we showed them how they could market the program to their own customers and residents. If you?re shopping at a store, and you lock your keys in your car, and the store manager gets you a discount on lockout service, aren?t you going to go back to that store and recommend it to others? That made it a win-win-win-win.

Of course, I wish the story had a better ending. The customer service network program is one of the things that got me promoted from driver to manager, and then I had to start babysitting adults, the office manager left for greener pastures, and eventually the program languished due to lack of attention. In retrospect, I should have found a way to keep it flourishing, because the return on investment was undeniably positive.

If I can help you with your business in any way, I will. Feel free to call me any time to talk about ways for you to promote your business, or ways to babysit adults. I?d be honored, really.

Have a safe and profitable week.

Legal Intro

service - Many individuals mistakenly think that estate planning only involves the writing of your will. Estate planning, however, also can involve financial, tax, medical and business planning. A will is a component of the planning process, however, you will need other documents also to totally address your estate planning needs.

Additionally, there are many issues to take into account in creating an estate plan. To start with, consider the next questions: Exactly what are my assets and what is their approximate value? Whom do I wish to receive those assets-and when? Who should manage those assets basically cannot-either within my lifetime or after my death? Who should be responsible for looking after my minor children basically become not able to look after them myself? Who should make decisions on my small behalf concerning my care and welfare if I become unable to care for myself? What do I want done with my remains after I die and where would I want them buried, scattered or otherwise not laid to relax? Thus, through proper estate planning, you are able to determine: How and by whom your assets will probably be managed to save you time on your lifetime if you ever become unable to manage them yourself.. When and under what circumstances it makes sense to distribute your assets on your lifetime. How and to whom your assets will be distributed after your death. How and also by whom your individual care will probably be managed and the way healthcare decisions will probably be made during your lifetime in the event you become not able to look after yourself.

Elder Law: Abuse Or Neglect

help - Elder abuse can be an intentional act (abuse) or perhaps a not enough knowledge/ability to supply choose to an older person (neglect). Elder abuse may appear in many different ways that include assaultive acts, neglect, financial exploitation and/or psychological or emotional mistreatment. An elderly body's thought as somebody that is age 65 or older.

Assault includes causing pain and/or injury by molesting, slapping, bruising, forced sex, cutting, burning, restraining.

Neglect includes refusal or failure to provide adequate care, food, shelter, clothing, medicine, and/or medical aides (glasses, dentures, walkers).

Financial exploitation includes illegal or incorrect use of cash, bank cards, funds or another assets.

Psychological/emotional mistreatment includes mental suffering or despair brought on by name calling, yelling, insulting, ignoring, isolating, threatening, or demanding acts.

Abuse could also are the violation of basic rights such as the right to worship together chooses, the right to assembly, the liberty to become left alone, and also the to handle one?s personal and financial affairs unless declared incompetent at doing this by due process of law.

Senior Legal Assistance: Estate Planning

An income Trust can help insure your assets will probably be managed in accordance with your wishes-even in the event you become not able to manage them yourself.

In creating your living trust, you could work as its trustee initially or you may choose another person to take action. You can name a trustee to adopt within the trust's management for your leisure should you ever become unable or unwilling to control it yourself. At your death, the trustee-similar for the executor of a will-would then gather your assets, pay any debts, claims and taxes, and distribute your assets in accordance with your instructions. Unlike a will, however, this can be done without court supervision or approval.

However, few people requires a living trust. Young couples without significant assets and without children, who want to leave their assets to one another when the first one of them dies do not require a living trust and would not benefit from having a living trust. Other persons that do not have significant assets and also have very easy estate plans also do not need an income trust. Finally, anybody who wants court supervision on the administration of his or her estate shouldn't use a living trust. The greater the value of your assets (particularly if own real-estate), the higher the dependence on a full time income trust. Having a living trust might be essential in the wedding of an accident or sudden illness.

Guardianship Or Caregiver Agreements

help - Conservatorship is a legal term discussing an individual who may be deemed gravely disabled through the court and not able to meet their basic needs of food, clothing, and shelter. There are two types of conservatorships: Lanterman Petris-Short (Lanterman Petris Short act of 1967, referred to as LPS) and Probate conservatorships. They may be governed by the state's individual laws. In California, they may be governed from the California Probate Code, and Welfare and Institutions Codes. Some states or jurisdictions refer to it as a guardianship, or even a trustee, rather than conservator.

Conservatorships are usually set up for severely mentally ill individuals who are gravely disabled, elderly people who have Dementia or Alzheimer's Disease who lack mental capacity, or individuals with developmental disabilities who may or may not lack mental capacity. Mental capacity must be based on a medical physician or even a psychiatrist familiar with the area and is also documented and presented to a legal court as evidence.

A small conservatorship usually refers to individuals who are developmentally disabled, and so they can retain additional control over their personal affairs than other conservatees if they are capable. For example, they could retain their to decide where they might live.

Legal

Creating a basic comprehension of the above-described processes, along with the appropriate documents and notes in hand, will assist you once you talk with either an estate planning specialist or elder law specialist. It also brings out you a stride better resolving any legal issues you could have - which in turn will minimize your reliance on attorneys. Perhaps, it's going to even minimize family strife.

FARMINGDALE, N.Y. (AP) ? Padraig Harrington found a way to take some of the attention away from Tiger Woods and Rory McIlroy on Thursday. He made six birdies on the tough back nine of Bethpage Black and opened the FedEx Cup playoffs with a 7-under 64 for a one-shot lead at The Barclays.

And that surely got the attention of Ryder Cup captain Jose Maria Olazabal.

Harrington has to rely on a captain's pick to make his seventh straight European team, and that looks to be unlikely. Not only has the three-time major champion gone four years without winning against a strong field, he and Olazabal are not the best of friends after a dispute at the Seve Trophy from nine years ago.

The Irishman had the toughest time Thursday after he got off the difficult Black course. There were so many questions about the Ryder Cup, his chances of making the team and what he has to do to impress Olazabal, that at one point Harrington adopted the American way.

"The only answer I can give at this stage is I'm pleading the Fifth Amendment on that one," Harrington said. "I honestly don't know what to say. I don't want to go in there and try too desperately to beg for a pick, or I don't want to go in there and give excuses for anything. I'll just leave it be what it is. I'm just going to play golf."

That part was superb on a calm day that became increasingly warm.

It took Harrington a few holes to realize that he was back at Bethpage Black, but not at the U.S. Open. The greens were soft. The rough was deep, but not terribly dense. The pressure was not quite the same. And par wasn't going to cut it.

He came to life on the back nine with four straight birdies to cap off his 64, giving him a one-shot lead over Nick Watney and Brian Harman among the early starters. The hotter it became, the crustier the greens were, and it was unlikely anyone would catch him. No one did.

Sergio Garcia was part of the group at 66, while defending champion Dustin Johnson and Rickie Fowler, both trying to make their own impression as potential picks by U.S. captain Davis Love III, were in the group at 67.

There were 73 players from the 123-man field at par or better, not the kind of scoring associated with Bethpage Black.

Thousands of fans chased after Woods and McIlroy, in the marquee group based on their standing in the FedEx Cup ? Woods at No. 1, McIlroy at No. 3. Both of them got off to a reasonable start. Woods scrambled nicely to recover from a few errant shots and scratched out a 68. McIlroy smashed one driver after another to set up short irons into the greens, and while he had three birdies through six holes, he let the good start get away from him and settled for a 69.

If this is a rivalry, it figures to be a friendly one. Woods genuinely likes this 23-year-old from Northern Ireland, who already has two eight-shot wins in the majors. He chatted more than usual, even for a Thursday, and during one wait on the par-3 14th, McIlroy listened intently with a smile on his face as Woods told a story, then broke into a big laugh upon hearing the punch line.

Worth repeating for a family newspaper?

"No," McIlroy said with another laugh.

"He's a nice kid, he really is," Woods said. "As I said yesterday, I played with him in Abu Dhabi. We struck up a friendship back then, and it's continued. And I think it's only going to get better."

Woods won the U.S. Open at Bethpage Black in 2002, and he tied for sixth when the U.S. Open returned to this public course on Long Island in 2009. It looks the same, especially how the rough frames each fairway. And while there were differences in the softness of the greens and hole locations, the most obvious difference was scoring.

"I shot 3-under par and I'm not even in the top 10," Woods said. "So it's a little different deal."

Harrington was even par through four holes, typically not a bad score, except that he watched Troy Matteson open with a birdie on the second hole and chip in for eagle on the fourth to reach 3 under early in the round.

"It definitely helped me cross that divide between thinking I'm at a U.S. Open and level par is going to be the winning total this week," Harrington said. "This is much more of a sprint. You're going to need to be 12-under par at the end of the week, or who knows, but it ain't going to be level par."

Harrington would figure to face a different kind of pressure ? getting on the Ryder Cup team ? but he found a certain peace after realizing he couldn't earn his way onto the team after the PGA Championship. Even though Europe's team is not finalized until after this week, ranking points from The Barclays don't count.

So he's out. Unless he wins. And even that might not matter.

Olazabal said at the PGA Championship that Harrington would have to do something extraordinary to make the team. He was told of Harrington's 64 and was asked what would constitute extraordinary.

"At least a win," Olazabal said.

Olazabal and Harrington had a tense moment at the 2003 Seve Trophy when Harrington questioned the Spaniard repairing pitch marks. Olazabal felt his integrity had been questioned, conceded the hole and they had a face-to-face discussion behind the green.

Does that still linger? Might it make a difference?

"From the character that he is, I believe he would put winning way above anything that's personal," Harrington said. "The Ryder Cup means so much to Europe, particularly to Jose as a European player. Nobody ? bar Seve ? would understand in his mind what it means to Europe. Winning is what's important to him. I can't see personal coming into it to get a winning team."

Harrington then caught himself for talking about the very subject he wants to avoid. He would rather talk about his 64 at Bethpage Black, a strong effort even in soft conditions, or his chances to move up in the FedEx Cup standings and give himself a chance at the $10 million bonus prize.

"We're talking about the wrong stuff," he said. "But I'm Irish, and being brought up in Ireland, we pay a lot of attention to bookmakers and their odds. And I'm sure if I went and had a look at the odds, I would be a long shot to make the team."
